Terms and Conditions of Sale

Article 1 — Purpose

These Terms and Conditions of Sale (hereinafter the « Terms ») govern the contractual relationship between VICTORIA PILATES, an EURL with share capital of €1,000.00, registered with the Paris Trade and Companies Register under number 941 447 674, operating the studio indar (hereinafter « the Studio »), and any natural person purchasing a service (hereinafter « the Client »).

The Terms apply to all services offered by the Studio : group Reformer classes, class packs, memberships and reduced rates, whether purchased online via the BSPORT platform or directly at the Studio.

Any booking or purchase implies full and unreserved acceptance of these Terms.

Article 2 — Services

The Studio offers group Reformer classes (pilates, fitness, stretching, yogaformer, Men Only!) delivered in small groups of no more than six people. The duration, content and intensity of the classes are detailed on indar-studio.com and on the BSPORT booking platform.

The Studio reserves the right to change schedules, class content or coaches, subject to informing Clients as soon as possible.

Article 3 — Registration and booking

To book a class, the Client must create an account on the BSPORT platform and hold a valid pack or membership. The booking is confirmed once the time slot is selected and validated on BSPORT.

The Client undertakes to provide accurate and up-to-date information at registration and is responsible for the confidentiality of their login credentials.

Article 4 — Prices and payment terms

Current prices are displayed on indar-studio.com and on the BSPORT platform. They are stated in euros, all taxes included.

The Studio offers the following options :

• Pack Découverte — 2 classes, €40 (valid 1 month)
• Pack Essentiel — 5 classes, €160 (valid 2 months)
• Pack Régulier — 10 classes, €300 (valid 4 months)
• Pack Engagé — 20 classes, €560 (valid 6 months)
• Student rate — €25 per class (on presentation of a student card)

Payment is made in full at the time of purchase, by bank card, via the secure BSPORT platform. The Studio reserves the right to change its prices at any time. Price changes do not apply to packs and memberships already purchased.

Article 5 — Pack validity

Each pack has a validity period indicated at purchase. After this period, unused classes are lost and cannot be refunded, postponed or exchanged.

Packs are strictly personal and registered to one person. They cannot be assigned or transferred to a third party.

Article 6 — Cancellation and rescheduling

The Client may cancel or reschedule a booking up to 12 hours before the start of the class, directly via the BSPORT platform. The class credit is then returned to their account.

Any cancellation made less than 12 hours before the class, as well as any unreported absence (no-show), results in the loss of the class credit. No refund or rescheduling will be granted.

Article 7 — Right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for leisure services to be provided on a specific date. Once a booking has been made and the class has taken place, no refund will be possible.

For any unused pack (no class booked or used), the Client has 14 days from purchase to exercise their right of withdrawal by sending a request by email to hello@indarstudio.com.

Article 8 — Cancellation of a class by the Studio

The Studio reserves the right to cancel a class in the event of force majeure, coach unavailability or insufficient participants. In such cases, the Client will be informed as soon as possible and the class credit will be automatically returned to their BSPORT account.

Article 9 — Studio rules

The Client undertakes to observe the following rules :

• Arrive at least 5 minutes before the start of the class
• Wear suitable sportswear and non-slip socks (available for purchase at the Studio)
• Respect the equipment provided and report any malfunction
• Inform the coach of any medical condition, injury or pregnancy before the class
• Behave respectfully towards other participants and the Studio team

The Studio reserves the right to refuse access to anyone who does not comply with these rules or whose behaviour would disrupt the smooth running of the class.

Article 10 — Liability

Practising on the Reformer is at the Client's own responsibility. The Client declares being in good physical condition and having consulted a doctor in case of any doubt about their fitness to undertake physical activity.

The Studio accepts no liability for theft, loss or damage to Clients' personal belongings within the Studio. It is recommended not to leave valuables in the changing room.

Article 11 — Personal data

Personal data collected in connection with the commercial relationship is processed in accordance with our Privacy Policy.

Article 12 — Intellectual property

All content on indar-studio.com and the Studio's communication materials (text, images, logos, videos) is protected by intellectual property law. Any unauthorised reproduction or use is prohibited.

Article 13 — Mediation and disputes

In the event of a dispute, the Client may send a written complaint to the Studio by email to hello@indarstudio.com. The Studio undertakes to respond within a reasonable time.

In accordance with Articles L.612-1 et seq. of the French Consumer Code, the Client may use the consumer mediation service free of charge. The competent mediator is : [TO BE COMPLETED — mediator name].

Failing an amicable resolution, the dispute will be submitted to the competent courts of Paris.

Article 14 — Applicable law

These Terms are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the courts of Paris shall have sole jurisdiction.
